Pre-Bankruptcy Budget and Credit Counseling Disclosures
1) Take Charge America, Inc. (TCA) is a non-profit agency in accordance with Section 501 (c) (3) of the Internal Revenue Code.
2) TCA is approved to issue certificates in compliance with the Bankruptcy Code. The approval to issue certificates by the United States Trustee Program does not endorse or assure the quality of any one particular agency's services.
3) Our Pre-Petition Bankruptcy Counseling Program is approved in all judicial districts with the exception of Massachusetts, North Carolina, Alabama, Guam, Northern Mariana Islands, Puerto Rico and the Virgin Islands.
4) Our credit counselors are trained and certified in accordance with Association for Financial Counseling and Planning Education (AFCPE) standards for credit counselors. The pre-petition bankruptcy counseling session will be conducted by an AFCPE certified counselor.
5) TCA counselors do not answer legal questions about bankruptcy, or advise anyone to file for bankruptcy. This decision is to be made by each person after consultation with an attorney. TCA counselors provide impartial and accurate information. TCA does not refer consumers to attorneys or attorney offices.

7) TCA will not provide any information about this session to a credit reporting agency. Neither bankruptcy counseling nor credit counseling will impact your credit score or credit report; although filing for bankruptcy, enrolling in a debt management plan or electing other options, may impact your credit score and credit report.
8) The fee for the Pre-Petition Bankruptcy Counseling session by one of our certified credit counselors is $50. The $50 fee is good for either a single filer or joint filers if both attend the same session. We will waive the pre-petition bankruptcy counseling session fee for debtors whose household income is equal to or less than 150% of the estimated poverty threshold for their applicable family size as published in the current Federal Poverty Levels Guidelines.
9) TCA receives funding in the form of donations and contributions from entities that support financial education such as the federal and state governments, banks and credit card companies. We also collect fees from some clients.
10) TCA does not pay or receive fees or other consideration for pre-petition bankruptcy counseling program referrals.
11) Within one business day upon successfully completing the session and satisfaction of payment, TCA will provide a certificate of completion for you to present to your bankruptcy lawyer and bankruptcy court.
